Terms of Use - MyFlow
The "MyFlow Terms of Use" set forth the conditions for using the services related to MyFlow provided by Tryxia LLC, between the Provider and the users of the Application.
1. Agreement and Scope of these Terms
- Users must agree to all terms of these Terms and comply with them.
- At the start of the Application, users agree to these Terms and a separately defined "Privacy Policy."
2. User Information
- The Provider may collect information such as device name, OS, and the Application's identification ID.
- The Provider may collect unique information of your device for the proper functioning of the Application's PUSH notification feature.
3. About Premium Plan
- The Services are available for free, but with limited functionality. A plan is available to access all features of the Services.
4. Termination of Use
- Upon termination of use, no refunds will be provided for any fees already received.
5. User's Responsibility
- Users are responsible for their use of the Application and for all activities and consequences resulting from it.
- Users are solely responsible for personal information and schedules recorded using the Application.
- If a user defames another person, violates privacy rights, discloses third-party personal information without consent, infringes copyright, or otherwise violates the rights of others, they must resolve these issues at their own expense and responsibility, and the Provider bears no liability.
6. Prohibited Actions
- Users must not engage in actions that hinder the operation of the Application or are otherwise prohibited. Violation of these prohibitions may result in forced withdrawal, suspension of use, or deletion of entered data.
7. Disclaimer
- The Provider will provide support for usage issues to the extent possible but is not liable for any damage resulting from the use of the Application.
- The Provider does not guarantee that the Services are compatible with all devices, and acknowledges that updates to the OS may cause operational or display issues with the Services.
8. Liability for Damages
- If the User's actions cause damage to the Provider (including claims arising from such actions), the User is liable to compensate the Provider for the full amount of the damage (including legal fees paid by the Provider).
9. Use of the Services
- Users are responsible for the communication costs associated with downloading the Application and using the Services.
- Users acknowledge that they may be unable to view or use parts of the Services depending on their internet connection environment.
10. Termination of the Services
- The Services may be terminated or suspended, or their basic content may change, after a certain notice period. Users acknowledge and agree to this in advance.
- Upon termination of the Services, all information held by the user on the Services will be lost, and any information/data provided by the user for subscription or use of the Services will be deleted.
- The Provider bears no liability for any direct or indirect losses or damages incurred by the user due to the termination of the Services.
11. Interruption of the Services
- The Services may be interrupted without prior notice or consent from the user under certain circumstances, such as maintenance due to equipment failure or the suspension of external services used by the Services.
12. Jurisdiction and Governing Law
- In the event of a dispute related to these Terms between the User and the Provider, both parties shall engage in discussions in good faith.
- In the event that discussions do not resolve the dispute, both parties agree in advance to submit to the exclusive jurisdiction of the first instance court located in the Provider's residence for the resolution of the dispute.
- Users agree in advance that these Terms and other guidelines or terms presented by the Provider on this site will be interpreted in accordance with the laws of Japan.
